Guidelines to NRIs for Real Estate Investment in India.

NRIs are permitted to buy or acquire real estate in India in accordance with the Foreign Exchange Management Regulations of 2018. With the exception of agricultural properties like plantations, farmhouses, and agricultural lands, the Indian government permits NRIs to invest in a variety of residential and commercial real estate assets. The amount of properties an NRI may possess is unrestricted by the government, nevertheless. However, in order to purchase any property, an NRI must have enough capital in their account, which includes money from incoming remittances.

Steps to follow by NRIs

Documents Required:

As an NRI you’re required to furnish certain documents. These documents consist of:

  • Indian Passport and Visa Copies
  • Work permit from your country of residence
  • Recent income tax returns and
  • Last six months’ payment slips
  • Title deed and No Objection Certificate ( NOC) from the society.

Delegating through Special Power of Attorney

For NRIs who cannot be present in India physically for the property purchase transactions, the Power of Attorney(POA) is the solution. As a NRI, you can appoint or delegate a trusted individual such as your close relative, family member or friend to act on behalf of your transaction and take care of the paperwork.

To obtain a POA, you need to visit the Indian embassy in the city where you reside. Once you receive that, you send the POA to India which will undergo adjudication. It’s mandatory to instruct your designated POA to keep all the documents safe and forward them to you when you need them.

NRE and NRO accounts for financial safety

As an NRI, you’re advised to maintain both NRE ( Non-Resident External) and NRO (Non-Resident Ordinary) accounts in India. The NRE account helps you transfer the foreign earnings to India and the NRO account allows you to manage your Indian income sources and accept foreign currency deposits.

Documents required for an NRI to continue his/her ownership in India

  • Copy of the passport
  • Copy of the PAN card
  • Copy of the OCI/PIO card (if applicable)
  • Copy of the sale deed or title deed of the property
  • Copy of the latest property tax receipt
  • Copy of the latest electricity bill or water bill
  • A letter of authorization to a representative in India (if applicable)

Eligible Property Buying Types

NRIs can invest in residential and commercial properties.

Unlimited Property Ownership

There is no restriction on the number of residential or commercial properties an NRI can own in India.

Property must be purchased using funds from:NRE (Non-Resident External) account, NRO (Non-Resident Ordinary) account and FCNR (Foreign Currency Non-Resident) account

Home Loans

NRIs are eligible to avail home loans in India from banks or housing finance companies, subject to documentation and eligibility.

Joint Ownership

NRIs can jointly own property with another NRI or Indian citizen. However, joint ownership with a non-eligible person (like a foreign national) is restricted.

Sale proceeds of property can be repatriated (sent abroad) under certain limits and conditions: 1) For two properties only 2) Subject to FEMA norms and documentation

Power of Attorney (PoA)

NRIs can appoint a trusted person (usually a relative or legal representative in India) via PoA to manage property transactions on their behalf.

Tax Implications

NRIs must comply with TDS (Tax Deducted at Source), capital gains tax, and income tax regulations applicable in India.

All properties must be legally registered in the NRI's name with appropriate stamp duty and registration charges paid.
